Preamble: These terms and conditions apply, on the one hand, between Enjoy your Deco and, on the other hand, between any natural or legal person wishing to make a purchase on the website www.enjoyyourdeco.com, hereinafter referred to as "THE CUSTOMER."

Article 1: Purpose.

These terms and conditions of sale are intended to define the contractual relationship between ENJOY YOUR DECO and THE CUSTOMER and the conditions applicable to any purchase made through the merchant site, whether THE CUSTOMER is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by THE CUSTOMER of these terms and conditions of sale. These general terms and conditions of sale will prevail over any other general or specific conditions not expressly agreed to by ENJOY YOUR DECO. ENJOY YOUR DECO reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by THE CUSTOMER.

Article 2: Characteristics of the goods and services offered

The products and services offered are those listed on the ENJOY YOUR DECOC website. These products and services are offered while stocks last. The photographs in the catalog are as accurate as possible but cannot guarantee perfect similarity with the product, particularly with regard to colors. In addition, some products may present variations in shade within the same color.

Article 3: Rates

Prices are indicated in euros including VAT; they do not include delivery costs, which are invoiced in addition and indicated before the order is confirmed. Prices include the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in all product prices on the site. ENJOY YOUR DECO reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to THE CUSTOMER. For any order to the French Overseas Territories and countries outside the European Union, the possibility of a tax to be paid during customs clearance cannot be excluded. To find out the current rate, we invite you to inquire with your customs office.

Article 4: Orders
The CUSTOMER wishing to purchase a product or service must: – complete the online quote, providing all the references for the chosen products or services; – confirm the quote to convert it into an order; – complete the identification form, providing all the requested contact information; – confirm the order after reviewing it; – make payment under the conditions provided.

Confirmation of the order implies acceptance of these general terms and conditions of sale, acknowledgment of full knowledge of them, and waiver of the right to invoke their own purchasing conditions or other conditions. All information provided and the recorded confirmation will constitute proof of the transaction. Confirmation will constitute signature and acceptance of the transactions carried out. ENJOY YOUR DECO will confirm the recorded order by email.

Article 5: Return of merchandise
All return requests must be made by email or telephone. This only applies to unmarked items; altered items (embroidery, printing, patches, badges) will not be accepted.

After the return has been accepted, the package must be returned, properly packaged, and postage-paid to the following address:

All return requests must be made within a maximum of 14 days from the day after delivery of the order; after this period, no return requests will be accepted.

-For individuals: In accordance with Article L121-21 of the French Consumer Code, customers who are non-professional individuals have a cooling-off period of fourteen days from the delivery of their order to return the product to the seller for a refund without penalty, excluding return shipping costs. In accordance with Article L121-20-8, the right of withdrawal cannot be exercised on goods made or customized to the consumer's specifications.

- For businesses, associations, and local authorities: In the event of an accepted return of goods, a fixed amount representing 15% of the order amount will be retained for handling costs.

Please note: Products with a marking requested by the CUSTOMER are not subject to the withdrawal period and will not be returned. In accordance with Article L121-21-8 of the French Consumer Code.

Article 6: Respect for intellectual property rights

In the case of an order for items to be branded, THE CUSTOMER assures ENJOY YOUR DECO that the visuals and texts used are free of third-party rights. In the event of a claim for violation of third-party rights, THE CUSTOMER shall release ENJOY YOUR DECO from any liability. THE CUSTOMER shall remain fully liable and shall compensate ENJOY YOUR DECO for all damages suffered.

Article 7: Withdrawal

CUSTOMERS, non-professional individuals, have a fourteen-day cooling-off period from the delivery of their order to return the product to the seller for a refund without penalty, excluding return shipping costs. For professional CUSTOMERS, a fixed amount representing 15% of the order amount will be retained for handling fees.

Products with a marking requested by the CUSTOMER are not subject to the cooling-off period. They cannot be returned or refunded.

Article 8: Complaints and After-Sales Service
Claims regarding a delivery must be made by mail or email within 14 days of the date of receipt of the package.

Article 9: Payment

To pay for their order, THE CUSTOMER has the choice of all the payment methods offered on the order form: – Secure online payment by credit card via Crédit Mutuel's CM-CIC 3D Secure payment system. – Secure online payment via PayPal. – Payment by check. – Payment by bank transfer. – Payment by money order

The price charged to the CUSTOMER is the price indicated on the order confirmation generated on the ENJOY YOUR DECO website, during order validation. The sale price is given immediately without discount. Payment in full must be made at the time of ordering. At no time may the amounts paid be considered deposits. For online payment, payment is made directly via Crédit Mutuel's CM-CIC payment interface or via PayPal, in a secure environment, without going through the website server. The order validated by THE CUSTOMER will only be considered effective once the relevant bank payment centers have given their approval. In case of refusal by the said centers, the order will be automatically canceled and THE CUSTOMER notified by email. Furthermore, ENJOY YOUR DECO reserves the right to refuse any order from a customer with whom there is a dispute or to limit the payment methods available to THE CUSTOMER based on the value of the order, the destination or other objective criteria

Article 10: Deliveries and Deadlines

Deliveries are made to the address indicated on the order form or to a nearby collection point.

In the event of damage during transport (loss, loss, or theft), ENJOY YOUR DECO disclaims all liability and cannot refund the order.

Delivery times are provided for informational purposes only; they are estimated times. Delivery delays related to the order's delivery cannot be grounds for refunding the order.

For all orders with a fixed delivery date, the CUSTOMER must inform ENJOY YOUR DECO of the date by which the order must be delivered. This information must be provided in the order's comments section. ENJOY YOUR DECO reserves the right to cancel and refund the order if the requested delivery times are not achievable.

When the delivery time of the order exceeds thirty days from the time stated at the time of order placement, the sales contract may be terminated and the CUSTOMER reimbursed.

Article 11: Marking

In the event of marking by ENJOY YOUR DECO of the ordered products: 11.1 THE CUSTOMER undertakes not to provide elements to be marked whose content does not contravene the laws in force in the countries concerned in terms of intellectual property, defamation, pornography, offenses against public decency, child protection, incitement to racial hatred and any other theme affecting respect for the human person; in general, THE CUSTOMER undertakes not to infringe the rights of any third parties whatsoever. 11.2 An order is only definitively taken into account when all the marking elements are validated by our services. In the event of non-feasibility, THE CUSTOMER will be contacted by ENJOY YOUR DECO to find a solution or to cancel the order. 11.3 The marking dimensions are given for information purposes only and may be modified, at the discretion of the manufacturing operator, depending on the visual provided, the cut and the size of the products. 11.4 Under no circumstances does ENJOY YOUR DECO guarantee a perfect match of the marking colors with the visual provided by THE CUSTOMER

Article 12: Liability

The total and cumulative liability of ENJOY YOUR DECO, whatever the cause, is limited to the amount paid by THE CUSTOMER to ENJOY YOUR DECO for the order in question. Under no circumstances will ENJOY YOUR DECO be entitled to compensation for indirect and/or immaterial or moral damages, including in particular financial or commercial damages such as loss of profit, loss of orders, loss of business, loss of data, loss of earnings, damage to image, interruption of service, as well as damages of the same nature resulting from a claim brought against ENJOY YOUR DECO by THE CUSTOMER due to damages suffered by a third party. ENJOY YOUR DECO shall not be held liable in the event of any damage to the customer's data, the latter being responsible for backing up the data at its own expense. This data will under no circumstances be re-implanted by ENJOY YOUR DECO on the equipment in the event of loss. In any event, ENJOY YOUR DECO is released from all liability and cannot be held liable for compensation in cases of force majeure.

Article 13: Intellectual property

All elements of the website are and remain the intellectual and exclusive property of ENJOY YOUR DECO. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of ENJOY YOUR DECO..

Article 14: Personal data

In accordance with the French Data Protection Act of January 6, 1978, personal information relating to buyers may be subject to automated processing. ENJOY YOUR DECO reserves the right to collect information about buyers, including through the use of cookies, and, if it so wishes, to share the collected information with commercial partners. WHO IS RESPONSIBLE FOR PROCESSING MY DATA?

The controller of your data is the company ENJOY YOUR DECO itself.

TYPE OF DATA COLLECTED AND LOCATION OF DATA

Our database servers are located at OVH, in French data centers. For each order you place on enjoyyourdeco.com, we store the data necessary to process your order (product purchased, size, color, quantity, customization, type of printing) and to ship your order (title, last name, first name, address, telephone number), and for customer information (date of birth, email address). This data is deleted upon request, and each newsletter includes an unsubscribe link. Under no circumstances does ENJOY YOUR DECO store your credit card number; only our payment partner CM-CIC Monetico has access to your credit card number at the time of payment.

After your order, your email address, last name, first name, and order reference are not shared with any other company.

ENJOY YOUR DECO also reserves the right to collect browsing data through the use of cookies, in accordance with applicable legislation. A cookie is a computer file stored on the Customer's computer hard drive. Its purpose is to indicate a previous visit by the Customer or Prospect to the enjoyyourdeco.com website. The Customer can refuse the use of these cookies during their first visit via a dedicated banner displayed on the first visit. At any time during subsequent visits, the user can also delete their cookies in the following ways: – by clearing their cookies via their web or mobile browser.

DATA RETENTION

ENJOY YOUR DECO undertakes to delete or archive Customer data after a period of 3 years following the last purchase, and Prospect data after a period of 3 years following the last interaction. An exception is data necessary to establish proof of a right or contract, which may be archived, as provided for by the provisions of the French Commercial Code relating to the retention period for books and documents created during commercial activities, and the French Consumer Code relating to the retention of contracts concluded electronically.

ENJOY YOUR DECO never resells personal data to third parties. None of the data we collect is given, rented, sold, or exchanged with third-party companies.

Article 15: Archiving – Proof

ENJOY YOUR DECO will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. ENJOY YOUR DECO's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 16: Dispute Resolution

These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is granted to the competent courts of Angers notwithstanding multiple defendants or third-party claims.
